Are Ontario Youth Apprenticeship Program (OYAP) participants exempt from minimum working age regulations?

No. Regulations made under the Occupational Health and Safety Act (OHSA) set out the minimum working age for certain industries. OYAP participants are not exempt from these regulations. Go to the Minimum age for work page on Ontario.ca for more information.

Do the exemptions apply when the student is working at the placement outside of the specified co-op days or hours (e.g. after school, weekends) but still during the specified co-op period?

It depends on whether the student has a registered training agreement (RTA) or not: Ontario Youth Apprenticeship Program (OYAP) participants (i.e., they do not have an RTA): the exemptions only apply while they are working at the specified placement site for the dates and hours indicated on the Work Education Agreement (WEA). Sometimes the employer/sponsor is unaware of the exemption for the practise of compulsory trades. How can I make the employer/sponsor aware?

School boards that deliver the Ontario Youth Apprenticeship Program (OYAP) have created an OYAP Placement Card that includes the exemption regulation. Please contact the chair of your regional OYAP recruiters’ group for access to the card.

Who will develop the apprenticeship program standards and issue certifications during the transition of Skilled Trades Ontario into a mature state?

The ministry continues to handle apprenticeship registration while the Skilled Trades Ontario is responsible for certification until it reaches a mature state and is able to assume responsibility for the delivery of apprenticeship registration. Skilled Trades Ontario is responsible for the apprenticeship program standards development.

When will Skilled Trades Ontario agency reach a mature state?

The ministry is taking a thoughtful and measured approach to the transition to Skilled Trades Ontario. The ministry will continue to co-deliver existing apprenticeship services until the agency has reached a mature state.
